Terms and Conditions

We don't want our terms and conditions to blind you with science. The Fitness Society aims to be as clear as possible when it comes to the small print. If you have any queries with any of the following Terms and Conditions please don't hesitate to ask us:

Principle Terms

  1. The agreement starts:
    If you are already at the gym, once you have indicated your acceptance in the Declaration section of this web sign-up process.
    OR
    If you are not at the gym, once you have indicated your acceptance in the Declaration section of this web sign-up process and then entered the gym premises or after a period of seven days has passed - whichever is sooner.

  2. Your membership starts immediately.

  3. You will be entitled to the rights and privileges of the Membership type chosen.

Fees and Charges

  1. The joining administration charge is payable immediately. This includes a one off complimentary Personal Training session to set you off on the right track.

  2. The direct debit Payment Amount is due from you to us. You are obligated to make the "minimum number of Direct Debit Payments" stated with the first one being paid on the 1st Direct Debit Payment Date, the second on the 2nd Direct Debit Payment Date and then every month thereafter. You are obligated to make every Direct Debit payment, regardless of non-attendance except where the cancellation terms below or any terms which are specified on-line are met.

  3. You agree to promptly advise us of any changes to the Member Details provided.

Renewal

  1. Once you have completed the minimum number of Direct Debit payments, we will automatically continue to collect the Direct Debit Payment Amount every month unless you cancel (in which case you need to give us not less than ten working days' notice). Your membership will be extended by one month each payment ("Renewal Period"). This Renewal Direct Debit Payment Amount may only be amended if we advise you in writing giving no less than 30 days' notice.

  2. During this Renewal Period you can cancel by cancelling your Direct Debit with the Fitness Society - just provide us with the ten working days' notice as stated above.

  3. We advise that once your membership cancellation has been confirmed by our membership team you cancel your direct debit mandate directly with your bank.

Cancellation and Freezing Membership

Non-Contracted memberships:

  1. Should your physical or financial circumstances change you can freeze or exit the contract at any time, without a cancellation charge. All we ask is that you provide ten working days' notice before your direct debit is due. The maximum length you may freeze a contract for is six months, once your requested freeze or six months is up your membership and direct debit will automatically restart unless you notify us otherwise. If you want to freeze the contract for any longer than six months, we will talk to you on an individual basis to agree if this is possible. Please be aware that a membership freeze has a small cost associated with it each month, please ask a membership advisor of this cost before committing to freezing your membership.

  2. We advise that once your membership cancellation has been confirmed by our membership team you cancel your direct debit mandate directly with your bank.

Contracted Memberships:

  1. Relocation: This agreement can be cancelled in the event that your new permanent address is more than 15 miles away from the facility upon receipt of a copy utility bill or bank statement showing the new address.

  2. Long term (over 3 month) illness or injury: This agreement may be cancelled in the event of an illness, injury or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for 3 months or longer upon appropriate proof being provided.

  3. Redundancy: This agreement can be cancelled upon appropriate proof of redundancy from your employer or other loss of livelihood.

  4. Pregnancy: This agreement can be cancelled if you become pregnant upon the appropriate written proof being given. 
Please note - ANY Cancellation for the above reasons will not be effected until the appropriate proof is provided and received (in writing or via email) 
by Harlands or the Club.

  5. Breach: This agreement can be cancelled if we are in breach of contract including if we do not provide facilities or services you may reasonably 
expect and we have fallen well below that standard.

  6. Temporary Illness or Injury: This agreement may be frozen in the event of a temporary illness, injury or medical condition which in the written 
opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for a period of time.
Please note - ANY Freeze will not be effected until the appropriate proof is provided and received (in writing or via email) by Harlands or the Club. Please note - A freeze period does not affect the Minimum No. of Direct Debit Payments you are due to make and any payments remaining at the time of the freeze will remain due and recommence on a monthly basis once the freeze period has completed.

NOTE: Cancellation and freeze notice must be provided by either letter or e-mail. We also advise that once your membership cancellation has been confirmed by our membership team you cancel your direct debit mandate directly with your bank.

General Terms

  1. You agree to comply with the Gym Etiquette which is displayed in the club. We may make reasonable changes to these rules if we feel it will benefit the gym as a whole. If non-compliance with Gym Etiquette consistently causes damage to equipment, distress or disturbance to other members/staff we will need to discuss the issue with you and reserve the right to terminate this agreement.
